  1. Introduction These Terms of Service (“Terms”) govern your access to and use of Dragonfly Jewelry’s website, mobile applications, services, products, and related features (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

  • Prices listed are in the currency displayed and exclude applicable taxes and shipping unless stated otherwise.
  • We accept the payment methods displayed at checkout. You authorize us to charge your selected payment method for the total amount of the order.
  • You are responsible for any sales, use, VAT, customs duties, or other taxes associated with your purchase, except as otherwise required by law.
  1. Shipping and Delivery
  • Shipping estimates are provided at checkout; delivery dates are estimates and not guaranteed.
  • Title and risk of loss pass to you according to the shipping terms stated at checkout or, if none, upon delivery to the carrier.
  • International orders may be subject to import duties or customs fees; these are your responsibility.

  • For defective or incorrect items, contact us promptly and provide requested documentation (e.g., photos). We will evaluate and, if applicable, repair, replace, or refund at our discretion.

  • Custom, engraved, or made-to-order items may have different terms (including final sale). Any specific terms will be disclosed at the time of purchase.
  1. Product Descriptions and Availability
  • We strive for accuracy in product descriptions, images, and measurements. However, slight variations in color, size, finish, and materials may occur.
  • We do not warrant that product descriptions or other content are accurate, complete, reliable, current, or error-free.

  • You represent and warrant that you own or control all rights to your User Content and that it does not violate these Terms or any third-party rights.
  1. Prohibited Conduct You agree not to:

  • Interfere with or disrupt the Services or servers or networks connected to them;
  • Circumvent security measures or attempt to access accounts or data without authorization;
  • Use automated means to access, scrape, or collect data from the Services without permission.

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  • We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  1. Limitation of Liability
  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL DRAGONFLY JEWELRY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE SERVICES.
  • OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APPLICABLE ORDER DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

  1. Indemnification You agree to indemnify and hold Dragonfly Jewelry and its affiliates harmless from any claims, liabilities, losses, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

  2. Product Care and Safety

  • Jewelry may require special care. Any care instructions provided are recommendations; we are not responsible for damage resulting from improper use, alteration, or care.
  • If you have allergies or sensitivities to metals or materials, consult product specifications and a medical professional as needed before purchase.

  1. Recalls and Safety Notices If a product is subject to a recall or safety notice, we will comply with applicable laws and contact affected customers when contact information is available.

  2. Termination

  • We may suspend or terminate your access to the Services at any time for violation of these Terms, suspected fraudulent activity, legal reasons, or other business reasons.
  • Sections that by their nature should survive termination (e.g., Intellectual Property, Indemnification, Limitation of Liability, Governing Law) will survive.

  1. Modifications to Terms We may modify these Terms from time to time. Material changes will be posted with an updated effective date and, where required by law, notified to you. Continued use of the Services after changes constitutes acceptance.

  2. Governing Law and Dispute Resolution

  • These Terms and any disputes arising out of or related to them will be governed by the laws of the state in which Dragonfly Jewelry is headquartered (unless otherwise specified), without regard to conflict-of-law rules.
  • For disputes not resolved informally, you and we agree to submit to the exclusive jurisdiction of the courts in that state. If required by law, arbitration or different dispute resolution terms will be specified separately.

  1. Severability If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

  2. Assignment You may not assign or transfer these Terms or your rights without our prior written consent. Dragonfly Jewelry may assign these Terms in connection with a merger, acquisition, or sale of assets.
